Terms of Service

By creating an account or using IdeaForm (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

IdeaForm is operated by Peak Pulse (“we”, “us”, “our”). These terms govern your access to and use of the platform, APIs, and any related services.

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must be at least 16 years old to use the Service. If you are using IdeaForm on behalf of an organization, you represent that you have authority to bind that organization to these terms.

You agree not to use the Service to:

• Collect sensitive personal data (e.g., payment card numbers, government ID numbers, health records) without appropriate disclosures and legal basis.
• Distribute spam, phishing forms, or any content designed to deceive respondents.
• Violate any applicable law or regulation, including data protection laws in your jurisdiction.
• Infringe on the intellectual property rights of others.
• Attempt to gain unauthorized access to the Service or its infrastructure.
• Resell or sublicense access to the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

You retain ownership of the forms, questions, and response data you create through IdeaForm (“Your Content”). By using the Service, you grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate and improve the Service.

You are solely responsible for the legality of the data you collect from respondents, including obtaining any required consents and complying with applicable privacy laws (such as GDPR, CCPA, or equivalent local regulations).

IdeaForm uses AI to generate form structures from your prompts. AI-generated output is provided as a starting point and may contain inaccuracies or unsuitable suggestions. You are responsible for reviewing, editing, and verifying all AI-generated content before publishing a form.

We do not claim ownership of forms generated by AI on your behalf. However, we may use anonymized, aggregated prompt and usage data to improve the AI generation service.

Some features require a paid subscription. By subscribing, you authorize us (via our payment processor, Stripe) to charge the applicable fees on a recurring basis. All fees are non-refundable except where required by law or explicitly stated in our refund policy.

We may change pricing with at least 14 days' notice to your registered email address. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Free plans are subject to usage limits as described on our Pricing page. We reserve the right to restrict or terminate free accounts that exceed limits or are inactive for more than 12 months.

The IdeaForm name, logo, product design, and underlying software are owned by Peak Pulse and are protected by intellectual property laws. These terms do not grant you any right to use our trademarks, trade names, or other brand features without prior written permission.

We aim to keep IdeaForm available 24/7 but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. For significant changes to paid features, we will provide reasonable advance notice.

We may impose limits on usage, storage, or API calls at any time to ensure fair service to all users.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or that AI-generated output will be accurate or suitable for any purpose.

To the fullest extent permitted by law, Peak Pulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service — even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Service shall not exceed the amounts you paid us in the 12 months preceding the claim.

You may delete your account at any time from your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your account for violation of these terms, non-payment, or if we reasonably believe your use poses a risk to the Service or other users.

These terms are governed by the laws of the jurisdiction in which Peak Pulse is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction. If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect.
